Title: Will a Compatible Ink or Toner Cartridge Void My Warranty?

For years some supply dealers and manufactures have told their customers “If you use a product other that the manufactures OEM ink or toner cartridge this will void your warranty.” This as a scare tactic used to keep their customer from using remanufactured or compatible ink and toner products. Don’t worry using a toner cartridge other than the manufactures own brand will not void your warranty.

The Magnuson-Moss Warranty Improvement Act passed by Congress in 1975 prohibits companies from using “tie in sales” to void a warranty. The manufacture of the printer, copier or fax you are using cannot void the warranty on your machine just because you used toner or ink cartridges other than the printer or copier manufactures OEM brand. This prohibition includes the use of compatible cartridges and remanufactured cartridges as well.

U.S. law also prohibits the manufactures of your equipment from requiring the use of OEM ink and toner or charging extra fees if you use products other than OEM with their equipment. Those requirements and/or fees are in violation of existing anti-trust acts:

The Supreme Court (IBM vs. The United States) held that IBM could not threaten customers with termination of their data processing equipment lease just because they did not use supplies manufactured by IBM. Such practice constituted a tying agreement and was found to be in violation of the Sherman and Clayton Antitrust Law.

Free choice allows you the customer to choose whatever ink and toner cartridge you want. Your printer manufacture is aware of lower priced supplies. Threatening to void warranties and add additional service call charges for us of compatible ink and toner cartridges is their way of trying to limit competition.
